Terms of Reference

 

To determine applications under the Licensing Act 2003 as set out below:

 

  • Application for personal licence - If a representation is made and not withdrawn
  • Application for personal licence with unspent convictions - All cases
  • Application for premises licence/club premises certificate - If a representation is made and now withdrawn
  • Application for provisional statement - If a representation is made and not withdrawn
  • Application to vary premises licence/club premises certificate - If a representation is made and now withdrawn
  • Application to vary designated premises supervisor - If a police representation is made and now withdrawn
  • Application for transfer of premises licence - If a police representation is made and now withdrawn
  • Applications for interim authorities - If a police representation is made and not withdrawn
  • Application to review premises licence/club premises certificate - All cases
  • Application for summary review - All cases
  • Determination of a police representation to a temporary event notice - All cases

 

To determine applications under the Gambling Act 2005 as set out below:

 

  • Application for Premises Licence - If representation is made and not withdrawn
  • Application for a provisional statement - If representation is made and not withdrawn
  • Application to vary a Premises Licence - If representation is made and not withdrawn
  • Application for the transfer of a Premises Licence - Where representation is made by the Gambling Commission
  • Application for the reinstatement of a lapsed licence - If representation is made
  • Application to review a Premises Licence - All cases
  • Consideration of a temporary use notice - Where a representation has been made and not withdrawn
  • Decision to give a counter notice to a temporary use notice - All cases
  • Application for a Club Gaming/Club machine permits - Where objections have been made and not withdrawn
  • Cancellations of Club Gaming/Club machine permits - All cases
  • Application for Family Entertainment Centre Gaming Machine Permits - Where representation received from the Police or relevant offences identified
  • Application for Prize Gaming Permits - Where representation received from the Police or relevant offences identified
  • Refusal of an application to register as a small society lottery - Where it has been identified, following a hearing, that the grounds detailed in paragraphs 47 or 48 of Schedule 11 of the Gambling Act 2005 apply
  • Revocation of a registration as a small society lottery - Where it has been identified that grounds exist which would have resulted in a refusal to register if the application were made anew
  • To make an order under Section 284 of the Gambling Act 2005 removing the exemption of either the right to provide equal chance gaming 'on sale' alcohol licensed premises or the entitlement to provide two gaming machines in 'on sale' alcohol licensed premises - Where it has been determined that: (i) Allowing the exemption would not be reasonably consistent with licensing objectives; (ii) Where gaming has taken place on a premises in breach of a condition of either section 279 or section 282; (iii) Where the premises are mainly used for gaming and (iv) Where an offence has been committed under the Act on the premises
