Information about making claims for injury, damage and property damage. Also information on how to report an accident and reporting a fraudulent claim.

Since 1 October 2012, the council has held public and employers' liability insurance with the insurer detailed below:

How can I make an injury or damage claim against the council?

The council will not always be liable to compensate. Often events occur which are not due to any negligence. There is no automatic right to compensation and the majority of claims are not paid.

Negligence has to be established against the council for any claim to succeed and it is suggested claimants seek legal advice.

All claims must be made by email or in writing giving as much detail as possible and signed by the claimant or their nominated representative.

Please include the following details:

  • State you wish to make an injury or damage claim
  • Full name and address
  • Exact date and time of the incident
  • Exact location (photographs and or sketch map will assist)
  • Brief summary of the circumstances including details of what you wish to claim for
  • The reason why you think the council is at fault for the accident.

Once a claim has been submitted it will be passed to the council’s insurers who will handle the matter directly with you or your nominated representative.

If you have been injured on the public highway you should notify the Highways Maintenance Team.

How do I make a claim for property damage?

All claims must be made by email or writing giving as much detail as possible and signed by the claimant or their nominated representative. Please include the following details:

  • Full name and address
  • The exact date of the incident
  • Location of incident
  • A brief summary of the circumstances
  • Copy of any estimates or receipt for the damaged item(s)
  • Photographic evidence, if available
  • The reason why you think the council is at fault for this accident.

If this damage relates to council tenants' contents you should also notify your relevant Building Maintenance Unit in Goole, Beverley or Bridlington.

How can I report an accident between myself and a council-owned vehicle?

If you have been involved in a motor accident with one of the council’s vehicles please contact the council’s Insurance Section as soon as possible, providing details of both vehicles involved, when and where the incident occurred and what damage and or injuries resulted from the accident.

Exchange of information

In order to protect public funds, the council will take all relevant action to detect and prevent fraud.

Information provided to the council by claimants, excluding bank details, may be passed to others for the purpose of detection and prevention of fraud. This includes, but is not limited to, the Claims and Underwriting Exchange (CUE) run by the Insurance Database Services Ltd (IDSL) and the Motor Insurers Anti Fraud Register run by the Association of British Insurers. In dealing with a claim, searches may be made of these and other registers.

The council and its claims handlers will make use of the information given in respect of any claim as part of our ongoing efforts in the detection and prevention of fraud. For the same purpose details of any claim may be released to other organisations, which also have a duty to protect public funds.
