How can I make an injury or damage claim against the council?

The presence of a defect in the highway does not automatically mean we are liable to compensate you if you are injured or damage your property.

Negligence has to be established against the council for any claim to succeed and often events occur which are not due to any negligence. The majority of claims are not paid. You may want to seek independent legal advice.

All claims must be made by email or in writing giving as much detail as possible and signed by the claimant or their nominated representative.

Please include the following details:

  • State you wish to make an injury and/or damage claim
  • Full name and address
  • Exact date and time of the incident
  • Photographs of the exact defect which caused the injury or damage. Please make sure the photograph shows the defect within the surrounding area so it can be easily identified when your claim is investigated
  • Your direction of travel
  • Brief summary of the circumstances including details of what you wish to claim for
  • Copies of any estimates or receipts for damaged items
  • The reason why you think the council is at fault for the accident.

Please email your claim to:

Email: insurance@eastriding.gov.uk

or write to:

East Riding of Yorkshire Council
Insurance Section
County Hall
Beverley
East Riding of Yorkshire
HU17 9BD.

Once a claim has been submitted it will be passed to the council’s insurers who will handle the matter directly with you or your nominated representative.

If you have been injured on the public highway you should also notify the Highways Maintenance Team.

How do I make a claim for property damage?
