Guidance notes: The e-bike demo project

This practical initiative aims to provide residents like you with first-hand experience using electric cycles, while also encouraging a shift towards more sustainable travel habits.

We are proud to introduce our very own fleet of e-bikes, ready to be loaned out for periods of 2 to 4 weeks.

Each loaned e-bike will come fully equipped with essential safety gear, ensuring a secure and comfortable riding experience. This includes a Sold Secure Gold standard lock to keep your bike safe, a helmet to protect your head, and high-visibility clothing to make you more visible to other road users.

What happens next

You need to read through the terms and conditions, then complete the online form to confirm that you have read and agree to them.

Terms and conditions

Legal requirements

  1. The following conditions form the agreement between the East Riding of Yorkshire Council, (‘the council’), who administers the e-bike Demo Project (‘the project’) and the above named person (hereafter referred to as ‘you’), whereby an e-bike is loaned to you for a maximum period of up to 4 weeks.
  2. i) The e-bike shall at all times remain the property of the council.
    ii) The e-bike is insured for damage and theft and you will be responsible for all damage, theft and accidents to the e-bike that cannot be claimed against a third party of up to a maximum amount of £100.
    iii) Only you and no other person may use the e-bike and such use must only be for social, domestic, business, pleasure and to and from work or study.
    iv) The e-bike is fitted with a SEE SENSE tracker, the purpose of the tracker is to evaluate the effectiveness of the project, any data collected will be anonymous.
  3. i) You must comply with the Highway Code and all obligations imposed by the law or bylaws. You must not ride the e-bike while under the influence of drugs or alcohol.
    ii) Any repairs to the e-bike will be subject to authorisation from the ERYC project coordinator.
    iii) A lock will be issued with the e-bike. The e-bike must be locked when left, using the supplied lock and appropriate method shown at handover. The council shall not be liable for any loss or damage caused by the theft or attempted theft of the e-bike. If you tamper with the settings of the lock or fail to return it at the end of the agreement you will be charged for the cost of a replacement.
    iv) You will be provided with a helmet and hi-vis vest to wear when riding the e-bike.
    v) The council recommends you wear the safety equipment provided at all times when riding the e-bike.

Fees and payments

  1. At the end of the loan period:
    i) you must return the e-bike, manual, charger and lock in good condition or you will be charged for any repairs due to misuse or negligence
    ii) the council may terminate the agreement and take immediate repossession of the e-bike if you fail to comply with any of the terms of this agreement, or if the e-bike is misused or damaged.

Accident damage or theft

  1. i) You use the e-bike at your own risk and the council will not provide individual personal accident cover to cover any personal injuries you suffer while using the e-bike.
    ii)The council does not provide any liability cover for injury or damage caused to third parties. We recommend all customers arrange their own personal liability cover to meet any such claims.
    iii) In the event of a traffic accident or collision you must contact the ERYC Project coordinator at the earliest opportunity to complete an accident report form for our insurers and provide a full account of the incident. Accidents involving motorists must be reported to the police and a police log number must be provided to ERYC Project coordinator. If you or the third parties are both unhurt then you must obtain the following details of the third party:

    • Their name, address and telephone number
    • The registration number of their vehicle
    • Their insurance company and their insurance policy number

  2. At no point does the council accept any responsibility or liability for any injury sustained to the named person or death of the named person as a result of their participating in the e-bike Demo Project. (Except where due to council negligence).

  3. i) If, during the period of use, you are involved in or become aware of any accident, damage or loss involving the e-bike, whether acknowledged or denied, you must report it immediately to the ERYC Project coordinator.
    ii)You must provide full assistance to the council in respect of any claim or alleged claim arising from the use of the e-bike.
    iii) In the event of any damage to the e-bike you must contact the ERYC Project coordinator immediately so arrangements can be carried out to have the damaged assessed. The e-bike will be returned but will not be replaced by the council if you fail to report any damage.

  4. The council does not accept any liability or responsibility in the event of a puncture or the loss of keys. You must report this as soon as possible. You can make your own arrangements for these repairs or contact ERYC Project coordinator to request a quote. If you request a quote, it will include labour charges of £35 per hour and the cost of all replacement parts.

  5. i) If your bike is stolen you must ring the police immediately, with details of the bike stolen.
    ii) You must inform the police that the registered keeper is, e-bike Demo Project East Riding of Yorkshire Council.
    iii)You must also contact e-bike Demo Project, the police will provide you with a log number for the crime. You must provide this number to the e-bike Demo Project. If the police ask you to produce documents for the e-Bike you must inform e-bike Demo Project immediately.

  6. You will be financially responsible for any damage or repairs to the e-bike as a result of rider misuse or negligence.

Maintenance

  1. You will be responsible for the day-to-day maintenance and pre ride checks [see paragraph 13 and 14] and cleanliness of the e-bike as detailed in this document. Rider checks
  2. You need to ensure that the e-bike is kept in good working order. You will be required to carry out some basic checks before riding this includes:
    i) Check that all the lights (which must be used at all times) and the bell are working on a daily basis before you begin your journey.
    ii) Ensure that the brakes are operating correctly.
    iii) Check the tyre pressures once a week and inspect for any damage or wear.
    iv) Ensure the battery is charged regularly.
  3. You must not: i) Use a pressure washer on the e-bike.
    ii) Leave the e-bike parked unlocked.
    iii) Carry out any adjustments or modifications to any part of the e-bike. You will be shown how to carry out a full bike check as part of your pre-ride training (see paragraph 14)
  4. Before you can take the e-bike away ERYC will carry out a rider assessment (short 10 minute ride). This is also your opportunity to try the bike and ask any questions regarding the equipment. You will also be shown a pre ride 'M Check'. How to fit and wear a helmet and how to lock the e-bike.
  5. The council reserves the right to withdraw the e-bike at any time.

Bike tracker

The e-bike is fitted with a SEE SENSE tracker, the purpose of the tracker is to evaluate the effectiveness of the project, any data collected will be anonymous.

The type of personal information we collect and how we receive it

When you use a bicycle equipped with a See.Sense Fleet Tracking unit, we will collect telemetry information which includes the GPS position and time. This allows us to understand journey details including duration, speed, braking, swerving, bicycle characteristics and road surface data.

See.Sense do not receive personal information about the rider of the bike, and are therefore unable to identify a specific person from the GPS records. Because GPS records attach to an individual bike this is still considered personal information as it can be assumed it relates to a single person (even though See.Sense do not know who that person is).

See.Sense may share the following information with East Riding of Yorkshire Council:

  • Number of trips taken, average speed and active minutes
  • Total mileage travelled
  • CO2 savings compared to motorised vehicle journeys
  • Last recorded GPS Location (1 hour lag time)
  • Sensor readings for adverse braking, swerving, dwell and road surface.

See.Sense do not share with East Riding of Yorkshire Council:

  • Individual journey details (for example, at 10am – 10:30am, Bike ID #2 travelled from A to B).

Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information is your consent. You can remove your consent at any time. You can do this by contacting East Riding of Yorkshire at data.protection@eastriding.gov.uk.

How See.Sense store your personal information

Your information is securely stored in data centres in Ireland and accessed securely from the UK.

We keep point level GPS data for 5 years. We will then dispose of your information by aggregating it with other data such that individual points are no longer distinguishable.

Your data protection rights

Under data protection law, you have rights including:

  • Your right of access: you have the right to ask us for copies of your personal information.
  • Your right to rectification: you have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure: you have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing: you have the right to ask us to restrict the processing of your personal information in certain circumstances.
  • Your right to object to processing: you have the right to object to the processing of your personal information in certain circumstances.
  • Your right to data portability: you have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Please contact us at datacontroller@seesense.cc if you wish to make a request.

Governing law

See.Sense are a Northern Ireland based company. These terms and conditions are governed by and shall be construed in accordance with the laws of Northern Ireland. The parties to these terms submit to the exclusive jurisdiction of the courts of Northern Ireland. Furthermore, any action to enforce these terms and conditions shall be brought in the Courts of Northern Ireland. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

East Riding of Yorkshire are a Public register organisation based in the UK.

Indemnification

You agree to indemnify See.Sense, its contractors, licensors, partners, clients and supporters and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of any See.Sense services and your use of a bicycle or any experience or incident you have with a bicycle or a cyclist. You cycle at your own risk and you are responsible for ensuring that the bicycles you ride are in a roadworthy condition. You are responsible for observing the rules of the road and cycling in a safe and careful manner.

How to complain

If you have any concerns about our use of your personal information, you can make a complaint to See.Sense at datacontroller@seesense.cc or to East Riding of Yorkshire at data.protection@eastriding.gov.uk. You can also complain to the ICO if you are unhappy with how we have used your data.

Changes to this policy and terms

We reserve the right to change the Privacy Policy and Terms without notice. You acknowledge and agree that it is your responsibility to review the Privacy Policy and Terms periodically to familiarise yourself with any modifications. Your continued use of the Services after such modifications will constitute acknowledgement and agreement of the modified Privacy Policy and Terms.

Collecting your e-bike

We will email you to arrange handover of the e-bike. This will include a demonstration of the bike’s features and your rider assessment.

Enquire about extending your loan period

Normally the loan is for between 2 and 4 weeks and the agreed return date will be shown on your confirmation email. However, you may request an extension by emailing sustainabletravel@eastriding.gov.uk. Any extension will be subject to e-bike availability. We reserve the right to restrict it to a specific return date.

Returning your e-bike

We will email you near the end of your loan period to arrange for the return of the e-bike.
