What are the council’s Public Protection services?

The council's public protection services are made up of 5 service areas. All services work to ensure the health, welfare and safety of residents and visitors to the East Riding, also ensuring the welfare of animals are protected.

Private sector housing

Private sector housing are responsible for ensuring privately rented (and occasionally owner occupied) accommodation is fit for purpose and meets the living standards as specified in the Housing Act 2004, ensuring it does not pose a safety or health risk to the occupier or visitors to the property.

The officers are also there protecting tenants from illegal eviction and to support landlords, offering newsletters and sign posting to training when appropriate.

The private sector housing service also licence houses in multiple occupation and encourage long term empty properties to be repaired as necessary and re-occupied.

Environmental control/pest and dog warden services

Environmental control

Environmental control deals with a range of statutory nuisance and pollution issues including noise, smoke, air pollution, contaminated land, unauthorised encampments, filthy and verminous properties, fly-tipping on private land and public health funerals.

Dog warden and pest services

The dog wardens collect and detain stray dogs within the East Riding, they also deal with dog fouling and dog related nuisances. This service can also deal with micro-chipping offences.

The council also offers a pest control service available to treat a wide range of pests in domestic and business properties.

Health, safety and licensing services

Health and safety at work

The council's health and safety service investigate concerns relating to commercial business operations, as well as undertaking pro-active work to encourage and ensure safe practices for employees and the public using the business premises.

Not all businesses are regulated by the council, some are regulated by the Health and Safety Executive.

The health and safety team are all responsible for the enforcement of the smoke free regulations. Petroleum and explosive regulations and skin piercing and tattooing.

Licensing services

The council licensing service are responsible for the consideration, processing, compliance and enforcement of a wide range of areas including: taxis/gambling premises/alcohol licensing/late night refreshment/scrap metal dealers/caravan sites/street traders/pavement licensing/sex establishments and animal welfare licences.

Food Services and Animal Health

Food Services

The Food Services team deal with food safety and hygiene, food standards, animal feedstuffs, private water supplies and infectious disease control.

The team award the FSA’s Food Hygiene Rating Scheme ‘scores on the doors’, conduct enforcement sampling of food, water and feedstuffs, and may provide export health certificates where applicable.

The Animal Health team primarily deal with animal health and welfare matters affecting livestock animals.

Trading Standards

The trading standards service deal with consumer safety, age restricted products and business complaints.

The service also has a motor trade association aiming to improve motor sales services in the East Riding.

How do public protection services address compliance and enforcement?

Public Protection services have a major role to play in protecting, promoting, and improving the health, safety, and economic well-being of our communities. This role includes the enforcement of numerous statutes, many of which include criminal and civil sanctions on those who infringe the law. To ensure a fair and consistent approach to enforcement responsibilities the council adopted a Public Protection Enforcement Policy.

A wide range of enforcement tools are available to public protection officers, who work in line with the Regulators Compliance Code 2014, taking a stepped approach to enforcement, in some circumstances it may be necessary to use the most serious of sanctions.

This Policy explains how the council will use the powers under the Housing and Planning Act 2016 to ban landlords and property agents from renting out property in the private rented sector:

The overarching aim of this policy is to safeguard housing standards by ensuring compliance with the relevant legislation.

This policy sets out the principles that the East Riding of Yorkshire Council (the council) will apply in exercising its powers to require a relevant landlord (landlord) to pay a financial penalty for non-compliance:

East Riding of Yorkshire Council (ERYC) has adopted this policy on deciding financial penalties and the appropriateness of prosecution as an alternative to imposing financial penalties under the relevant letting agency legislation. It applies in relation to any decision made by the council in its capacity as Enforcement Authority under Sections 7 and 24 of the Tenant Fees Act 2019 respectively:
