Council acts to preserve Beverley's heritage via enforcement notice

The Planning Inspectorate has dismissed an appeal against a planning enforcement notice, issued by East Riding of Yorkshire Council to preserve the Beverley conservation area.

Planning permission was granted in 2022 for the erection of a replacement dwelling on land at 3 The Old Racing Stables, Beverley.

The site is located within the Beverley Conservation Area, in the vicinity of two grade II listed buildings, with previous applications for a larger development refused or amended to ensure a suitable scheme for its sensitive location

Work started in 2023 but did not proceed in accordance with the approved plans. As a result, the council considered it necessary to issue an enforcement notice in January 2024, with an appeal against the enforcement notice dismissed on Thursday 14 May 2026.

The Inspector agreed with the council’s reasons for issuing the enforcement notice and found that when compared to the approved dwelling, the building appears ill proportioned and top heavy, contrary to the historic pattern of development and disrupting the street hierarchy.

It was therefore concluded that the development neither preserves nor enhances the character and appearance of the Beverley Conservation Area or the settings of the nearby grade II listed buildings. Applying great weight and importance to the harm to the heritage assets, the Inspector found that the harm was not justified and that the public benefits of the development did not outweigh the adverse effects of the development.

The Inspector also attributed weight to the fact that there was evidence of intentional unauthorised development, because the appellant intended the development to be unauthorised or actively sought to harmfully flout the rules.

As a result of the enforcement notice being upheld, the requirements of the notice must be carried out within 6 months of the appeal decision, by Saturday 14 November 2026. The building must be altered so that it fully accords with the approved plans and all consequential requirements arising from planning permission

The Council's Planning Enforcement team will be closely monitoring the site to ensure compliance with the requirements of the notice.

An East Riding of Yorkshire Council spokesperson said: “It is essential that developers and residents abide by planning regulations and conservation zones, for the benefit of the whole community.”
