Article 4 Directions

Article 4 Directions are a means by which a local planning authority can bring within planning control, certain types of development, or changes of use, which would normally be permitted development (i.e. not require an application for planning permission).

What is an Article 4 Direction?

Under the Town and Country Planning (General Permitted Development) (England) Order 2015, the change of use from a dwellinghouse (Use Class C3) to a small House in Multiple Occupation (Use Class C4), occupied by up to six unrelated individuals, can normally take place without the need for planning permission.

An Article 4 Direction allows a Local Planning Authority to remove specified permitted development rights in defined areas where it is considered expedient to do so.

This Direction came into force on 21 November 1995 and restricts the carrying out of specific alterations, as far as windows and doors are concerned, to certain buildings within the village of Atwick because of their location directly overlooking the Village Green.

PUBLIC NOTICE

DIRECTION MADE UNDER ARTICLE 4 (1) OF THE TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 2015 (AS AMENDED) RELATING TO ALL RESIDENTIAL PROPERTIES WITHIN THE AREA OF GOOLE SHOWN ON THE PLAN BELOW.

Notice is hereby given that East Riding of Yorkshire Council has made a non-immediate Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 ("the Order") on 24 April 2026 ("the Direction").

The Direction removes permitted development rights for development consisting of the change of use of a building or land within its curtilage from a use falling within Class C3 (Dwellinghouses) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) to a use falling within Class C4 (house in multiple occupation) of that Schedule being development comprised within Class L (b) of Part 3 of Schedule 2 of the Order and not being development within any other class.

The effect of the Direction is that planning permission will be required for changes of use of any building from Class C3 (Dwellinghouses) to Class C4 (Houses in Multiple Occupation) from the date the Direction comes into force and such development shall not be carried out within the area unless planning permission is granted by the Council on an application made to the council under Part III of the Town and Country Planning Act 1990 (as amended).

The Direction applies to the areas are shown edged red on the maps attached to the Direction and located below. The statutory consultation period will run from 5 May to 16 June 2026.

Representations concerning the draft Article 4 Direction may be sent to the council during the statutory consultation period, which will run for 6 weeks from 5 May to 16 June 2026.

Subject to confirmation by the council, the Direction shall come into effect on 30 June 2027.

All representations will be considered before the Article Direction 4 is confirmed, and if confirmed, the Article 4 Direction will be published here.
