What is an Examination in Public?

As part of the process of preparing the Joint Minerals Local Plan, each document within the plan is subject to an ‘Examination in Public’. This is a form of public inquiry where an independent planning inspector, appointed by the Secretary of State, will ‘test’ the document to see if it meets the requirements of the relevant legislation and to see if it is ‘sound’. Soundness is tested by considering whether the document is positively prepared; justified; effective and consistent with national policy.

This page remains a record of the examination in public for the current Joint Minerals Plan (adopted 2019).

The Inspector's Matters, Issues and Questions (MIQs) and Guidance Note have been published for comment. The council and all other participants must submit their hearing statements to the Programme Officer by noon on Monday 3 December 2018. The documents provide further information and can be viewed in the Examination Library below (Ref: CD42 - CD44).

Where can I view the Main Modifications consultation?

East Riding of Yorkshire Council and Hull City Council consulted on proposed Main Modifications (MMs) to the emerging Joint Minerals Local Plan (the Plan) from Monday 11 March 2019 for 6 weeks. This consultation closed at 12 noon on Tuesday 23 April 2019. The MMs were identified and discussed at the examination in public hearing sessions that took place at County Hall, Beverley on 8 and 9 January 2019. The MMs address the concerns of objectors and address issues raised by the Independent Planning Inspector.

Following the consultation, all representations to the Schedule of MMs and SA and HRA Update Note were considered by the Inspector in the preparation of his final report which sets out any necessary modifications to make the plan ‘sound’ and legally compliant.

In addition to the MMs, the councils proposed a number of minor changes to the Plan, known as Additional Modifications (AMs). The AMs were published alongside the MMs for completeness, but were not examined by the Inspector. The AMs propose to address minor drafting errors and some factual corrections and do not affect the soundness of the Plan.

It must be noted that this consultation refers to the proposed MMs and no other aspect of the Plan. The MMs were put forward without prejudice to the Inspector’s final conclusions.
